Terms of Use

These Terms of Use govern your use of the Quem Companion mobile application and related services. By using the app, creating an account, or purchasing a subscription, you agree to these Terms.

1. The App

Quem Companion is a language learning and world companion app for the Quemish language and the world of Trexlin. The app includes lessons, practice tools, grammar and culture references, quests, challenges, progress tracking, avatar or identity features, AI-assisted tutoring, and subscription features.

2. Accounts and Access Levels

The app may offer different access levels, including guest, registered, subscriber, and internal admin access.

• Guest access: limited preview access. Guest progress may not be saved or recoverable.

• Registered access: account-based access with saved progress and limited premium features.

• Subscriber access: paid access to subscriber features while your subscription is active.

• Admin access: internal access for development and content management. Admin access is not sold as a subscription.

You are responsible for keeping your account credentials secure and for activity under your account.

3. Subscriptions, Free Trials, and Billing

Quem Companion may offer auto-renewable subscriptions through Apple in-app purchase, including monthly and annual Bloodsworn Subscription options. Subscription benefits may include full practice access, grammar drills, trials, quests, rewards, and increased daily Gahnesh interactions.

• Subscriptions are billed through your Apple Account.

• We do not collect or store your payment card information.

• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.

• Your Apple Account may be charged for renewal within 24 hours before the end of the current period.

• You can manage or cancel subscriptions in your Apple Account subscription settings.

• Free trial eligibility is determined by Apple and may be limited to eligible users or Apple IDs.

• If you start a free trial and do not cancel before the trial ends, Apple may begin billing the selected subscription.

• Refund requests are handled by Apple according to Apple's policies.

4. Changes to Features or Prices

We may update, improve, remove, or limit app features over time. Subscription prices, benefits, and access rules may change as allowed by Apple and applicable law. If Apple requires consent for a price increase, Apple will manage that process through the App Store.

5. AI Tutor and Generated Content

Quem Companion may include AI-assisted features, including Gahnesh chat, name enrichment, and pronunciation or speech generation. AI responses may be incomplete, inaccurate, or fictionalized. They are provided for learning and entertainment and should not be treated as professional, legal, medical, financial, or safety advice.

You are responsible for the prompts and content you submit. Do not submit sensitive personal information, confidential information, or content you do not have the right to use.

6. Acceptable Use

You agree not to:

• Use the app for unlawful, harmful, abusive, harassing, or fraudulent activity.

• Attempt to interfere with, overload, reverse engineer, scrape, or bypass the app or its backend services.

• Attempt to evade access limits, subscription rules, account rules, or security controls.

• Submit content that infringes another person's rights or violates applicable law.

• Misuse AI or speech features to generate harmful, deceptive, or unlawful content.

7. Intellectual Property

Quem Companion, Quemish, Trexlin, original text, lessons, grammar materials, culture materials, artwork, audio, UI design, characters, names, and related creative content are owned by us or our licensors and are protected by intellectual property laws. You may use the app for personal, non-commercial learning and entertainment. You may not copy, distribute, sell, publish, or create competing products from app content without written permission.

8. User Content

You retain ownership of content you submit, such as profile choices, prompts, chat inputs, or support messages. You grant us a limited license to use, process, store, transmit, and display that content as needed to operate, secure, support, and improve the app and related services.

9. Privacy

Your use of the app is also governed by our Privacy Policy, which explains how information is collected and used.

10. App Store Terms

If you downloaded Quem Companion through the Apple App Store, your use of the app is also subject to Apple's applicable terms, including the Apple Media Services Terms and, where applicable, Apple's standard licensed application end user license agreement. These Terms apply between you and us and do not replace Apple's terms.

11. Account Suspension or Termination

We may suspend or terminate access if we believe you have violated these Terms, created risk or liability, misused the app, or interfered with service operation. You may stop using the app at any time. Deleting the app does not automatically cancel an Apple subscription; subscriptions must be cancelled through Apple.

12. Disclaimers

The app is provided "as is" and "as available." We do not guarantee that the app will be uninterrupted, error-free, or available at all times. We do not guarantee specific learning outcomes, availability of any feature, or accuracy of AI-generated content.

13. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from your use of the app.

14. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will update the effective date and provide notice as appropriate. Your continued use of the app after changes take effect means you accept the updated Terms.
